These Terms of Service (“Terms”) govern your access to and use of our website, client intake forms, scheduling tools, client portal(s), text/SMS communications, and any related online services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
1) Scope of Services and Important Disclosures
We are an insurance agency. Our Services may include: Information about insurance and retirement-income-related insurance solutions (e.g., life insurance, annuities, long-term care or related coverage, as applicable), general retirement planning education and tools, and scheduling and communication tools to support prospective and current clients.
Not investment advisory services. Unless we explicitly state otherwise in a separate written agreement, we are not providing investment advisory services. Nothing on the Services is intended as individualized investment advice.
No tax or legal advice. We are not a law firm or accounting firm. Any tax or legal information is general in nature and you should consult your own professionals.
Product features and availability vary. Insurance products and riders vary by state, carrier, underwriting, and issue date. Product availability may depend on your state of residence and our carrier appointments.
2) No Insurance Coverage or Client Relationship by Website Use
Using the Services does not: Create an insurance policy, binder, or coverage of any kind,
guarantee eligibility, underwriting approval, issue, or pricing, or create a professional relationship beyond the limited use of the Services.
Any insurance coverage exists only if and when: An application is submitted and accepted by the issuing insurer, all underwriting and other conditions are satisfied, and the policy is issued and in force pursuant to its terms (including premium payment requirements).
3) Eligibility and Jurisdiction
You must be at least 18 years old to use the Services. We do not offer products or services in jurisdictions where doing so would be unlawful. We may limit or deny Services based on licensing, appointment status, and state requirements.
4) Educational Content; No Guarantees
The Services may include educational content (articles, videos, calculators, illustrations, guides, webinars, and similar materials). This content is provided for general informational purposes only.
No guarantee of results. Retirement outcomes depend on many factors. Hypothetical examples are illustrative only. Any examples, projections, or “what-if” scenarios are not promises of future results and may not reflect actual product performance or your actual circumstances.
5) Illustrations, Rates, and Annuity Disclosures (If Applicable)
If we provide insurance or annuity illustrations: Illustrations are typically based on current assumptions and may change.
Non-guaranteed elements (e.g., credited interest, dividends, caps/participation rates, bonuses, renewal rates, etc., depending on product type) may be changed by the insurer as permitted by the policy/contract.
You should rely on the policy/contract as the controlling document. Nothing in the Services overrides the terms of any policy, contract, prospectus, disclosure statement, or carrier form.
6) Account Registration and Security
If you use a portal or create an account: you must provide accurate information, you are responsible for safeguarding login credentials, and you agree to notify us promptly of unauthorized access.
We may suspend access to protect you, us, or others.
7) Scheduling, Calls, Email, and SMS/Text Consent
By providing your phone number and/or email, you consent to receive communications related to: scheduling and reminders, requested information you ask for, service updates related to your relationship with us.
SMS/Text: Message and data rates may apply. Message frequency varies. You can opt out of non-essential texts by replying STOP or contacting us at [Email]. Reply HELP for help (where supported).
We do not guarantee delivery timeframes for texts, emails, or voicemails.
8) Third-Party Links and Tools
The Services may link to or integrate with third-party tools (carriers, scheduling platforms, calculators, customer portals, etc.). We are not responsible for third-party content, availability, security, or practices. Your use of third-party services is at your own risk and subject to their terms.
9) Acceptable Use
You agree not to: Use the Services unlawfully, attempt unauthorized access to systems or data, transmit malware/spam, scrape or harvest data without permission, interfere with security or functionality, impersonate others or misrepresent your identity. We may suspend or terminate access for violations.
10) User Submissions
If you submit data (forms, documents, uploads, messages) through the Services (“Submissions”): You represent you have the right to submit them, and you grant us a limited license to use them to provide Services, operate our systems, and comply with legal obligations. Do not submit highly sensitive information through unsecured channels. Use secure portals when provided.
11) Privacy
Your use of the Services is subject to our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy on personal data handling, the Privacy Policy controls.
12) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, secure, or error-free.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR LOSS OF GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED $100.
Some jurisdictions do not allow certain limitations; in that case, liability is limited to the fullest extent permitted by law.
14) Indemnification
You agree to indemnify and hold harmless the Company and its owners, officers, directors, employees, and contractors from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, violation of these Terms, or violation of any law or third-party rights.
15) Suspension and Termination
We may suspend or terminate access to the Services if you violate these Terms, if we suspect fraud/misuse/security risks, or if required by law. You may stop using the Services at any time.
16) Changes to the Services or Terms
We may change the Services or these Terms from time to time. We will post updated Terms with a new Effective Date. Continued use after the Effective Date means you accept the updated Terms.
17) Governing Law and Venue
These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law rules. Any dispute arising out of or related to these Terms or the Services will be brought in the state or federal courts located in Johnson County, Kansas, and you consent to jurisdiction and venue there.
18) Electronic Notices and Consent
You consent to receive notices electronically (email, portal, website posting). Electronic notices satisfy legal requirements for written notice where permitted.
19) Severability
If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
20) Assignment
You may not assign your rights under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
21) Entire Agreement
These Terms, together with our Privacy Policy and any written engagement documents you sign, form the entire agreement regarding your use of the Services.
